Monitoring Desk — The next chief justice in line Justice Qazi Faez Isa, has written a letter to Chief Justice Umar Ata Bandial stating that the Presidential Reference and the constitutional petition of the Supreme Court Bar cannot be heard simultaneously.
In a three-page letter, Justice Faez Isa stated that he wonders how the court can order hearing of a reference even before it is filed.
Justice Isa says in his letter that the court would hear the constitution petition under article 183/3 and the court can pass its ruling on this but how can the Presidential Reference be heard with SC Bar’s petition simultaneously.
The letter raises the question of how the same bench can hold two different hearings at the same time.
In his letter, Justice Qazi Faiz Issa expressed reservations on the bench constituted to hear the presidential reference and the bar petition.
The letter said that the bench which has been constituted has 4th, 8th, and 13th number judges (seniority wise) of the apex court. “By doing so, you have deviated from the tradition of the former chief justices who had constituted the benches of the senior-most judges on constitutional matters.”
It is written in the letter that the eyes of the entire nation are now fixed on the Supreme Court. .
